If ADR Services is unavailable, an alternative forum will be selected. The arbitration will take place in Los Angeles, CA, and the arbitral forum's rules will apply. Non-appearance-based arbitration may be utilized for claims under USD 10,000.
  • Additional Rules for Non-appearance Arbitration: Non-appearance arbitration may be conducted via telephone, online, written submissions, or a combination thereof, chosen by the initiating party.
  • Fees: ADR Services' fee schedule applies, with CHP covering arbitration costs if it initiates the arbitration. If you initiate arbitration, you will pay the first $100 of the initial filing fee, while CHP will cover the remainder and both parties' administrative fees.
  • Authority of the Arbitrator: The arbitrator has jurisdiction to decide disputes and grant relief as per law and the Terms. The decision is final and binding.
  • Waiver of Jury Trial: Both parties waive the right to a trial by jury and agree to resolve disputes through arbitration.
  • Waiver of Class or Consolidated Actions: All disputes must be arbitrated or litigated individually, and class or consolidated actions are not permitted. Disputes regarding the validity of this waiver may be resolved by a court.
  • Right to Waive: The rights and limitations in this Arbitration Agreement may be waived by the party against whom the claim is asserted.
  • Opt-out: You have the option to opt out of this Arbitration Agreement within 30 days of becoming subject to it. To opt out, notify CHP in writing.
  • Small Claims Court: Either party may bring an individual action in small claims court.
  • Arbitration Agreement Survival: This Arbitration Agreement remains in effect after the termination of your relationship with CHP.
